The school is already planning their appeal.  They maintain that they alerted their students within two hours of the initial shooting, in full accordance with the law.  A spokesman for the schools stated, “DOE said anywhere between 24 to 48 hours is an appropriate notice.”  They further defend their actions by stating the DOE offers no clear definition of what a “timely matter” is when it comes to notifications.

The letter also complains about the manner in which the alert was ultimately issued.  DOE claims Virginia Tech failed to adhere to their own policy which states the chief of police is responsible for issuing alerts.  The school counters that their communications office was forced to send the notification, as their police were preoccupied investigating and handling the shooting.  With a proper alert system similar to most emergency phone answering services, which can instantly send texts, voice messages, instant messages to chat services and emails, there is no excuse for their delay.
